This is a petition under Articles 226 and 227 of the Constitution to call up and quash by certiorari an order dated December 17, 1969 by which the service of the Petitioner, who was appointed as an Excise Sub-Inspector on probation, was terminated. The Petitioner has further prayed for a direction that he should be reinstated in service and paid his full salary from the date on which his service was terminated.
The main facts of the case on which this petition is founded are not in contest and may be shortly stated.
By an order dated January 16, 1964, the Petitioner, who was serving as a clerk in the office of the District Excise Officer, Raigarh, was appointed as an Excise Sub-Inspector on probation for two years with effect from February 1, 1964. In due course, the Petitioner joined the training classes at Gwalior on February 1, 1964, completed his training there and was thereafter posted in Surguja district where he was given practical training. Following this, he worked as an Excise Sub-Inspector at several places. The last place he worked was at Bilaspur where he received an order of transfer to Chhatarpur.
