Petitioner, Pro Bono vide this Writ Petition seeks quashment of Memorandum of Association 2014 (referred as MoA 2014) framed under the provisions Mahdya Pradesh Societies Registration Act, 1973 being ultra vires section 26 of the University Grants Commission Act, 1956 and the Regulations framed thereunder, viz, UGC (Institutions Deemed To Be Universities) Regulations, 2010. As a consequence of Memorandum of Association being declared ultra vires petitioner seeks quashment of appointment of respondent No. 4 as a Vice Chancellor, of respondent No. 3 – University by declaring that the Search Committee constituted under MoA 2014 is invalid. Further relief sought by the petitioner is direction to respondents to follow MoA 2013 which was duly approved by the UGC and Regulations, 2010.
