Najma Begam v. Mohd. Hameel

Headnote:Civil P. C., 1908 -- S. 24 -- transfer of case -- parties already fighting two cases at Jabalpur -- third case pending in Bhopal -- transferred to Jabalpur being convenient to both.

        The petitioners claims that it would be more appropriate to transfer the case· pending against her at Bhopal to a competent subordinate Court at Jabalpur to enable her to contest the same properly. It is urged that the respondent is already contesting the two cases at Jabalpur filed against him by the petitioner without making any grievance of inconvenience. In such a situation, it is claimed that the trial of all the three cases at one place. Obviously at Jabalpur, would be more convenient to everyone. The difficulties, in these circumstances, of the petitioner are also urged in support of this contention.

        Held : In my opinion, this application should be allowed. Admittedly, the respondent has to appear at Jabalpur in two cases, which are pending here and he has made no grievance in this respect. In such a situation, the trial of the third matter between the parties also at Jabalpur would be more appropriate and convenient for both, which would also avoid any undue harassment to the petitioner, who is certainly less advantageously placed as compared with the respondent. Application allowed.
