JUDGMENT

Sunita Agarwal, J.—Heard Shri Mehul Khare, learned counsel for the petitioner and Shri Jagdish Prasad Mishra, learned Advocate for the respondents.

2. With the consent of learned counsel for the parties, the matter has been heard for final disposal at the admission stage itself.

3. By means of the present petition, the order passed by revisional court dated 30.3.2017 in Civil Revision No.30 of 2015 (Harpal Singh v. Tejpal Singh) is under challenge.

4. The petitioner is defendant in Original Suit No.145 of 2008 (Harpal Singh v. Tejpal Singh) filed for the relief of cancellation of registered sale deed dated 20.10.2003 on the ground that the balance sale consideration of Rs.1,40,000/- has not been paid by the defendant/vendee till the time mentioned in the sale deed itself.

5. The written statement was filed by the petitioner contesting the matter on the ground that the entire sale consideration of Rs.2,00,000/- had been paid to the plaintiff before execution of the sale deed. The suit has been filed in order to harass the defendant who is real brother of the plaintiff.

6. During the pendency of the said suit, amendment application has been filed on 18.3.2011 with the assertion th
