JUDGMENT
Ravi Nath Tilhari, J.—Heard Shri Shailendra Singh Rajawat, learned counsel for the appellant and perused the material on record.
2. This first appeal under Section 19 of the Family Court Act, 1984, has been filed challenging the judgment and order dated 06.03.2021 passed by the Additional Principal Judge, Court No. 6, Family Court, Lucknow in Original Suit No. 23 of 2019, Satish Maurya Vs. Divya Neha, under Section 13 of the Hindu Marriage Act, 1955.
3. By means of the judgment and order dated 06.03.2021, the suit for divorce filed by the appellant has been dismissed, but a decree for judicial separation has been passed.
4. The marriage of the appellant with the respondent was solemnized on 08.02.2015 according to the Hindu rites and rituals. On the facts stated in the divorce petition, the suit was filed for a decree of divorce on 03.01.2019. The suit proceeded exparte vide order dated 23.11.2019, which order was recalled on 11.11.2020, but inspite thereof the written statement was not filed.
