Hidayatulla, J—The plaintiff Kisanlal is the appellant here. Defendant no. 1 Lala Sheoshankar and defendant no. 2 Tuljabai are the son-in-law and wife respectively of Lala Ganeshprasad. The remaining defendants are said to belong to the joint family of the plaintiff a genealogy of which is given in my judgment in First Appeal no. 45 of 1944 Reported at page 834 of this volume decided today. The suit was filed in respect of a house situated at Nagpur called the Brandy shop house in this case. The plaintiff's suit was for a declaration that the house belonged to the joint family composed of the plaintiff and defendants 3--9, for possession of that house and for refund of Rs. 1,080 being three years' rent of that house said to have been recovered by Lala Sheoshankar from the tenants and appropriated by him.
2. The plaintiff alleged that the family being indebted resorted to various decrees to save the famliy property and executed a large number of sham documents in favour of family friends. Among such documents were the two farkatnamas executed by the Lala brothers in favour of Govindprasad. I have referred to this part of the case more fully in connection with First Appeal no.
