JUDGMENT

1. This is a Plaintiff's appeal in a suit for partition and separate possession of property which, according to the Plaintiff, is joint family property. The Defendants are the Plaintiff's nephew and nieces. The family tree is as under.

2. The defences to the action are : (1) that the estate is impartible and the rule of primogeniture applies, (2) an estoppel, (3) a family settlement, (4) ouster, and (5) fraud. The Plaintiff lost on the first three points and so his suit was dismissed
