JUDGMENT

Skemp, J. - This judgment will dispose of Criminal Reviaions Nos. 1256, 1257, 1258 and 1299 of 1940. They have arisen from cases in which the findings are as follows: In village Ghuman, police-station Dera Baba Nanak, District Gurdaspur, there lived five brothers named Santa Singh, Banta Singh, Fauja Singh, Saudagar Singh and Ujagar Singh. Of these brothers, Fauja Singh alone was married to a woman named Viro. On 3rd October 1939, Santa Singh and Banta Singh quarrelled, either about cotton or about Mt. Viro, and Santa Singh killed Banta Singh with a blow on the head with a dang. The family and their follow villagers wished to hush up the affair and gave out that Banta Singh had died from natural causes. This came to the ears of Safdar Ali Shah, Assistant Sub-Inspector, Police Station, Dera Baba Nanak, who was temporarily in charge of the thana during the absence of his superior officer on casual leave, and he took a bribe of Rs. 85 through Chet Singh lambardar of Ghuman in order not to proceed with the case. The body of Banta Singh was then cremated in the presence of police constables from Dera Baba Nanak. This came to the knowledge of Head Constable Siraj Din on 5th Octob
