This is an application under Section 439 read with section 435 of the Code of Criminal Procedure. This Rule was issued calling upon the opposite parties to show cause as to why the impugned judgment and order of conviction and sentence dated 05.02.2020 passed by the learned Additional Sessions Judge, 5th Court, Chattogram in Criminal Appeal No.555 of 2018 dismissing the appeal and thereby affirming the judgment and order of conviction and sentence dated 23.10.2017 passed by the learned Senior Judicial Magistrate, Chattogram in C.R.
