1. The applicant has filed this MA praying for condonation of delay more than 17 years involving in filing this OA. Taking into consideration the reasons advanced therein, the delay is condoned. MA stands disposed off accordingly.

2. Under Section 14 of the Armed Forces Tribunal Act 2007, the Applicant has filed this OA praying for directing the Respondents to revise the pension of the Applicant as per Circular No 631 and pay the arrears to the applicant wef

01/1/2006 with 8% interest as per Circular No 165.

Vide Reply Statement, the Respondents have stated that the husband of the applicant was enrolled in the Army on 10/10/1980 and was discharged from service 31/10/2004 under Rule 13 (3) item III (i) on fulfilling the terms and conditions of his enrolment. He had rendered 24 years and 21 days of service and was granted service pension for life, which was revised from time to time. Post his discharge, husband of the applicant was granted Honorary rank of Nb Sub wef 01/11/2004 and consequently, his pension was revised as per extant rules and regulations. Further, vide Circular No 631 dated 05/3/2020, PCDA (P) has issued necessary guidelines to the Pension Disbursing Agencies (PDA) to revise the pension without any authentication or issuance of Corrigendum PPO and they are directly responsible for payment of revised rate of pension @Rs 8,330/- pm wef 01/1/2006 and subsequent revision of pension in accordance with the existing policy.

4. We have heard the counsels for the parties and perused the material on record.

5. It is not in dispute that husband of the applicant had rendered 24 years of service in the Army and was granted service pension for life. Post his discharge from service, husband of the applicant was granted honorary rank of Nb Sub wef 01/11/2004. As per copy of death certificate, Annexure A/4, husband of the applicant expired on 05/8/2020. Vide letter dated 04/9/2020, Records The Grenadiers, had also written to PNB, CPPC, Tonk Road, Jaipur, to grant revised pension to the pre-01/1/2006 retirees, who had been granted the honorary rank of Nb Sub in terms of Circular No 631 of PCDA (P).

In view of the foregoing, Respondent PDA, ie, Punjab National Bank, CPPC, Tonk Road, Jaipur is directed to revise the service pension of the late husband of the applicant for his lifetime wef 01/1/2006 till his demise on 05/8/2020 and revise the Family Pension to the applicant wef 06/8/2020 for life in terms of Circular No 631 of PCDA (P). The arrears accruing out of the revision wef 01/1/2006 shall be paid to the applicant within a period of three months form the date of receipt of a copy of this Order, failing which, the applicant shall be entitled to receive interest @6% till the actual date of its payment.

7. The OA is disposed off accordingly. No order on costs.
