1. Petitioners, in both these writ petitions, have challenged their respective termination orders whereby their services on the post of Assistant Teachers were declared void ab initio since its commencement.

2. Impugned orders are effectively similarly worded, therefore, after deleting the name of petitioner, operative part of one of the impugned order is reproduced hereinafter:

"उपरो्ሹ वቓኌ(cid:10)त तथ्यों एवं नि(cid:18)ष्क्ቧ(cid:22) के आधार पर स्प्ቖ है, निक ्ቦी XXX बी०टी०सी० योग्यताधारी अभ्यቕኍ+ ह।ै बी०टी०सी० अभ्यቓኌቕኍयों के लि.ए 15000 स०अ० भत+ के खो.े गये ्ቚቕኍम चर(cid:10) मे आप(cid:18)े बी०टी०सी० आह(cid:22)ता ्ቚा्቎ (cid:18) हो(cid:18)े के कार(cid:10) आवेद(cid:18) (cid:18)ही निकया। ्ቦी XXX सहायक अध्यापक ्ቚाቕኍनिमक निव्ቕा.य खा(cid:18)पुर निवकासखण्ड निब.ारी के ्ቛारा डी०एड०(निवशे्ቧ शिश्ቌा) अह(cid:22)ताधारिरयों के लि.ए खो.े गये नि्ቛतीय चर(cid:10) में बी०टी०सी० ्ቚशिश्ቌ(cid:10) अह(cid:22)ता पू(cid:10)(cid:22) निकये निब(cid:18)ा ही निद(cid:18)ांक 27.04.2015 को रजिMस्ट्रेश(cid:18) निकया है, Mबनिक बी०टी०सी० का परिर(cid:10)ाम निद(cid:18)ांक 29.04.2015 को घोनि्ቧत हुआ ह।ै आप ्ቛारा नि(cid:18)धा(cid:22)रिरत शቌኌै्ቌक अह(cid:22)ता ्ቚा्቎ निकये निब(cid:18)ा ही रजिMस्ट्रेश(cid:18) / आवेद(cid:18) कर(cid:18)ा ्ቚशिश्ቌ(cid:10) योM(cid:18)ा के काल्पनि(cid:18)क एवं ्ቔुनिटपू(cid:10)(cid:22) अंको का अंक(cid:18) कर(cid:18)े, चय(cid:18) ्ቚनिUया में ्ቝामांक सूच(cid:18)ाए दे(cid:18)े, भत+ ्ቚनिUया में तथ्य गोप(cid:18) कर कूटरच(cid:18)ा कर चय(cid:18) के लि.ए कुቜኌXसत ्ቚयास कर(cid:18)े या शास(cid:18)ादेश एवं निवभागीय नि(cid:18)यमों के निवरु्ቍ सहायक अध्यापक पद पर चय(cid:18) ्ቚा्቎ कर(cid:18)े के लि.ए आप पू(cid:10)(cid:22) रूप से दो्ቧी ह।ै अतः ्ቦी XXX सहायक अध्यापक ्ቚाቕኍनिमक निव्ቕा.य खा(cid:18)पुर निव०ख० निब.ारी की इस काया(cid:22).य के आदेश स०बे०्ቚ०/5215-5221/2016-17 निद(cid:18)ाक 02.07.2016 के ्ቛारा की गयी नि(cid:18)यनिु्ሹ ्ቚारम्भ से ही शून्य (Void abintio) कर नि(cid:18)रस्त करते हुए , नि(cid:18)यनिु्ሹ ቌኌतशिቕኍ से इ(cid:18)की सेवाएं समा्቎ की Mी है।"

This Court proceed to consider the rival submissions on basis of an undisputed fact that petitioners have filled and submitted their online forms disclosing wrongly that on date of submission of their online forms, they have passed their respective BTC Course as well as they have wrongly mentioned their marks obtained in BTC Course despite results were not announced. The Court also proceed on basis that all petitioners have subsequently passed their BTC Course within few days of submission of their online form and later on opening a window have made corrections in their respective application form also.

4. Facts of the case, which led to filing of these two writ petitions, in brief, are that State Government has issued Government Order dated

09.12.2014 whereby applications for recruitment of 15,000 Assistant Teachers in Junior Basic Schools run by Board of Basic Education, U.P. were invited. Thereafter a circular dated 11.12.2014 was issued disclosing time table for submission of forms etc. Admittedly petitioners have not submitted their online forms as they were not eligible on given date. For reference said circular, in its entirety, is reproduced hereinafter:
