1. Heard learned counsel for the applicant, learned A.G.A. for the State and perused the material brought on record. None has appeared on behalf of opposite party no.2 despite service of notice.

2. This application under Section 482 Cr.P.C. has been preferred for quashing of order dated 08.08.2022, passed by the Additional Chief Judicial Magistrate, Court No.18, Etah in Complaint Case No. 1873 of 2017 (Chote Lal Vs. Gore Lal), under Sections - 420, 406 I.P.C., Police Station - Jaithra, District - Etah, whereby applicant has been summoned for offences under Section - 420, 406 I.P.C. The order dated 16.05.2024, passed by Additional District and Sessions Judge, Fast Tract Court-II, Etah in Criminal Revision No. 140 of 2023 (Gore Lal Vs. Chote Lal and Another), is also being impugned.

3. It is submitted by learned counsel for the applicant that no prima facie case is made out against applicant. The only allegation made by complainant/opposite party no.2 is that about two years back he has lended Rs. 50,000/- to the applicant and in order to repay the said amount, the applicant has issued a cheque, which was dishonored.
