1. Heard Sri Navin Kumar, learned counsel for the petitioner, Sri Abhishek

Shukla, learned Additional Chief Standing Counsel, who has accepted notice on

behalf of the State respondents and Sri Pradeep Singh, learned counsel, who has

accepted notice on behalf of respondent no.5.

2. The present writ in the nature of PIL has raised the issue regarding illegal

encroachment over pond contained in Arazi No. 1005 area 0.530 hectare situated

at Village Khyokhar Abholi Tehsil Gyanpur District Sant Ravidas Nagar

(Bhadohi). A further prayer to decide the representation dated 06.06.2023 of the

petitioner within the stipulated time has been prayed for.

3. Sri Abhishek Shukla, learned Additional Chief Standing Counsel appearing on

behalf of the State submitted that as per the instructions received on 09.07.2023,

which are taken on record, the proceedings under Section 67 of the Revenue

Code, 2006 have already been drawn against the encroachers, who have been

arrayed as private respondents in the writ petition and the proceedings in

accordance with law would be undertaken against the encroachers.

4. At this juncture learned counsel for the petitioner submits that the proceedings

initiated under Section 67 of the Revenue Code, 2006 may be finally decided

within the time frame fixed by this Court.

5. Considering the submissions advanced by the learned counsel for the parties

and taking the note of the fact that the proceedings under Section 67 of the

Revenue Code, 2006 have already been initiated against the encrochers, the

Court is of the opinion that the present PIL may be disposed of requiring the

authorities concerned to decide the proceedings under Section 67 of the Revenue

Code, 2006 within a period of four months from the date of service of certified

copy of the order of this Court.

6. With the above observations this writ petition is disposed of.
