1. As informed by learned State Law Officer, notice to the informant has been served on 30.08.2024, but none is present on behalf of the informant.

2. Heard Sri Dwijendra Prasad, learned counsel for the applicant and Ms. Ifrah Islam, learned State Law Officer and perused the material available on record.

3. Applicant seeks bail in Case Crime No. 208 of 2024, under Sections 363, 366, 376(3) of I.P.C., Section 4(2) of POCSO Act and Section 3(2)(V) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, Police Station - Jasrana, District - Firozabad, during the pendency of trial.

PROSECUTION STORY:

4. The FIR was instituted by the informant stating that his daughter was missing since 21.05.2024 at about 04:00 pm and it was revealed that she used to talk to a person bearing mobile no.9720199024.

ARGUMENTS ON BEHALF OF APPLICANT:

5. The applicant has been falsely implicated in the present case due to ulterior motive. He has nothing to do with the said offence as alleged in the FIR.

6. The FIR is delayed by about one day and there is no explanation of the said delay caused.

7. The victim is the consenting party as is but evident from the fact that mob
