ALLAHABAD HIGH COURT
RAMESH KUMAR AND ANOTHER – Appellant
Versus
State – Respondent
A482/43984/2022
Proceedings under Section 482 Cr.P.C. cannot be quashed based on disputed questions of fact, and the court must rely on the allegations made in the FIR and the material collected during the investigation to determine whether an offence is disclosed.
Headnote:
CRIMINAL PROCEDURE CODE - QUASHING OF PROCEEDINGS - NO OFFENCE DISCLOSED
Fact of the Case:
The applicants filed an application under Section 482 Cr.P.C. to quash the charge sheet, cognizance order, and further proceedings in a case involving allegations of assault. The applicants claimed that the case was instituted with malafide intention and that no offence was disclosed against them.
Finding of the Court:
The court found that prima facie, an offence was disclosed against the applicants based on the allegations made in the FIR and the material collected during the investigation.
Issues: Whether the charge sheet, cognizance order, and further proceedings should be quashed for lack of offence disclosure.
Ratio Decidendi: The court relied on the principles established in R.P. Kapur Vs. State of Punjab, State of Haryana Vs. Bhajan Lal, State of Bihar Vs. P.P. Sharma, and Zandu Pharmaceutical Works Ltd. Vs. Mohd. Saraful Haq to hold that disputed questions of fact cannot be considered at the stage of quashing proceedings.
Final Decision: The court refused to quash the impugned charge sheet, cognizance order, and further proceedings. However, the court directed that if the applicants appeared before the lower court within three weeks and applied for bail, their application should be considered in accordance with the law laid down in Satender Kumar Antil Vs. Central Bureau of Investigation.
