Heard Sri Radhey Shyam Yadav, learned counsel for the

petitioner and perused the record.

By means of this petition filed under Article 227 of the

Constitution, the petitioner wants expeditious disposal of

Original Suit No. 632 of 2020 titled as Niranjan Singh vs.

Chandra Prakash pending before the Civil Judge (J.D.), Kol,

Aligarh.

Counsel for the petitioner submitted that the respondent has

already put in appearance and has also filed his objection to the

6-C application.

Learned Standing Counsel has no objection in case if a

direction is issued for disposal of aforesaid temporary

injunction application (Paper No.- 6C) strictly in accordance

with law and after putting to notice all the concerned parties.

In view of the above, this petition stands disposed of with a

direction to the trial court concerned to dispose of the pending

6-C application considering the objections of the defendants-

respondents as expeditiously as possible preferably within a

period of three months from the date of presentation of certified

copy of this order without granting unnecessary adjournments

to either of the parties at the same time giving full opportunity

of hearing to either of the parties.

However, if for any technical reason and unavoidable

circumstances the aforesaid order is not complied with in a

sense that the appeal does not get disposed of within time

framed by this Court, such delay will not by itself hold the

Presiding Judge personally liable for any contempt of this

Court.
