This bail application has been moved by the applicant, Safaqat,

in Case Crime No. 94 of 2022, under Section-377, 506 I.P.C. &

5/6 of Protection of Children From Sexual Offences Act, Police

Station-Naubasta, District-Kanpur.

Heard learned counsel for the applicant, and learned AGA

representing the State. Perused the record.

Learned counsel for the applicant argued that the applicant is

innocent; he has been falsely implicated in this very case crime

number and is languishing in jail since 08.02.2022; applicant is

is a shop owner; there is no evidence of penetrative sex; there is

allegation of oral sex; no such offence was ever committed;

there is no likelihood of applicant's fleeing from course of

justice or tempering with evidence in case of release on bail;

hence bail has been prayed for.

Learned AGA vehemently opposes bail.
