Heard Sri Virendra Singh Tomar, learned counsel for the

applicant and Sri Jhamman Ram, learned AGA for the State.

The instant application has been filed seeking release of the

applicant- Rahul on bail in Case Crime No.450 of 2022, under

Sections 323, 328, 498-A IPC and Section 3/4 D.P. Act, Police

Station Nai Mandi, District Muzaffar Nagar during pendency of

the trial in the court below.

According to the allegation, applicant along with his family

members used to torture his wife and forcibly administered

poisonous substance to her i.e. victim.

Learned counsel for the applicant submits that applicant is the

husband of the victim and he has falsely been implicated in the

present matter only due to the reason that some marital discord

arose between husband and wife and in-fact his wife i.e. victim

of the case herself consumed Sulfas a poisonous substance and

thereafter she with intention to harass the applicant lodged F.I.R
