The instant application has been filed seeking release of the

applicant on bail in Case Crime No.218 of 2022, under

Sections 353, 447, 506 IPC, 2/3 Prevention of Damage to

Public Property Act and Section 3/7 Criminal Law Amendment

Act, Police Station Sipri Bazar, District Jhansi during pendency

of the trial in the court below.

According to the FIR, applicant possessed the public land by

illegal encroachment.

Learned counsel for the applicant submitted that entire

allegation made against the applicant is totally false and

baseless and applicant neither made any encroachment over the

public land nor possess the same. He further submitted that all

the offences, in which, applicant has been made accused, the

maximum punishment is three years and applicant is in jail
