1. Heard learned counsel for the accused-applicant as well as learned A.G.A. for the State and perused the record.

2. This bail application has been moved by the accused/applicant- Sudhakar Alias Ram Chander for grant of bail in Case Crime No.0231 of 2021, under sections 304, 323 and 504 IPC lodged at police station Kotwali Tanda, district Ambedkar Nagar, during trial.

3. Learned counsel for the accused-applicant, while pressing the bail application, submits that the applicant has been falsely implicated in this case and, he has not committed any offence, as claimed by the prosecution. The FIR has been lodged only on the basis of suspicion and apprehension. Informant- Ramraj is not eye-witness and name of the applicant has been dragged into this case as it was revealed that he has taken the deceased with him on 15.10.2021 and thereafter deceased was assaulted by the applicant and co-accused- Sanjay Verma alias Ajay Kumar. The injuries are stated to have been sustained by the injured/deceased on 15.10.2021, but the FIR of the instant case could only be lodged on 01.11.2021 and no explanation of this huge delay of 15 days has been given either in the FIR or in the statement of any pros
