Heard learned counsel for the petitioner, learned counsel for the

respondent nos. 1, 2 and 4 and Sri Seshnath Yadav holding brief of

Sri Diwakar Singh, learned counsel for the respondent no. 3.

Pursuant to order of the Court dated 07.02.2023, learned counsel

for the petitioner has produced the Rules of U.P. Zila Parishad

Service Rules, 1970 (hereinafter referred to as "Rules, 1970") and

submitted that against the impugned order, there is provision of

appeal under Section 41 of Rules, 1970. He next submitted that

petition may be dismissed with liberty to file appeal and further

direction may be issued to decide the same at the earliest.

Accordingly, writ petition is dismissed with liberty to petitioner to

file appeal before the appropriate Authority as provided under

Section 41 of Rules, 1970. In case, any appeal is filed, the same

shall be decided within two months in accordance with Rules,

1970.
