Respondent :- State Of U.P. And 2 Others

Counsel for Petitioner :- Vidya Nath Shukla

Counsel for Respondent :- C.S.C.

Hon'ble Surya Prakash Kesarwani,J.

Hon'ble Jayant Banerji,J.

Heard Shri Vidhya Nath Shukla, learned counsel for the

petitioners and Shri Ankur Tandon, learned Standing Counsel

for the State-respondent.

On 21.11.2022, the following order was passed by the Court:-

"When a chak road was carved out on the abadi and bhumidhari lands of

the petitioner, the petitioner had approached this Court by means of Writ C

No.29039 of 2014 and on 26.05.2014 the Court had directed the third

respondent in the writ petition to look into the representation of the

petitioner.

The contention of learned counsel for the petitioner is that on 02.06.2014 a

representation was filed by the petitioner in compliance of the order of this

Court dated 26.05.2014 but the same has not been decided till date.

Learned Standing Counsel to take instructions as to why the aforesaid

representation of the petitioner has not been decided till date.

List this case on 08.12.2022 as fresh."

Today, learned Standing Counsel states that although letters

were written but the respondent-authorities have not sent the

instructions.

In view of the aforesaid, we direct the respondent no.3 to decide

the representation of the petitioners dated 25.04.2022 positively

within two months from the date of presentation of a certified

copy of this order, if not decided so far, after affording

reasonable opportunity of hearing to the petitioners and all the

parties concerned.

The writ petition is disposed of accordingly.

It is made clear that clear that we have not expressed any

opinion on merit of the case.
