1. Heard Sri A.K. Ojha, learned counsel for the applicant and Sri Ashutosh Singh, learned AGA for the State-respondent.
2. The instant application has been filed seeking release of the applicant on bail in Case Crime No. 612 of 2024, under Sections 111, 318, 61(2), 352, 351(3) BNS and 3/21 Banning of Unregulated Deposit Scheme Act, 2019 , Police Station- Kotwali, District- Lalitpur, during pendency of the trial in the court below.
3. FIR of the present case was lodged against three accused persons (non applicant) and according to FIR, nominated accused persons, who were agents of the company duped the informant by playing fraud.
4. Learned counsel for the applicant submitted that applicant was not named in the FIR but during investigation, he has been made accused in the present matter on the ground that he was also one of the agent of the company.
5. He further submitted that if through an agent of the company, any person deposited money in the company and subsequently company fails to return the money then agent of the company cannot be held responsible for that.
