1. Supplementary affidavit filed by learned counsel for the applicant is taken on record.
2. Heard learned counsel for the applicant and Sri P.K. Tripathi, learned A.G.A. for the State-opposite party.
3. The instant bail application under Section 483 B.N.S.S. has been filed with the prayer to enlarge the applicant on bail in Case Crime No. 183 of 2024, under Sections 115(2), 127(2), 308(5), 309(4), 351(3) B.N.S., Police Station Chola, District Bulandshahr during the pendency of the trial.
4. Learned counsel for the applicant submits that the applicant has been falsely implicated in the instant case. The incident is alleged to have occurred on 18.07.2024. The first information report was lodged on 02.09.2024. The delay is fatal to the prosecution case. In the CCTV footage accused Sonu @ Sohanpal was seen and was identified by the Bank Manager. Subsequently, in the statement of the informant it was alleged that Saurabh (named in the FIR) is the applicant. No test identification parade was got conducted by the police authorities.
