Heard learned counsel for the applicant and learned A.G.A for

the State.

There is allegation against the applicant and other co-accused

that they have caused dowry death of wife of the applicant.

Counsel for the applicant submits that it was a second marriage

of the applicant. Only because of his first wife used to frequent

his house occasionally, the deceased was annoyed. She did not

had cordial relation with the other family members of her

matrimonial home and therefore she committed suicide by way

of handing. The applicant has been falsely implicated in this

case. He is in jail since 06.12.2021 and has no criminal history

to his credit.

On the other hand learned A.G.A has opposed the prayer for

bail.

Keeping in view the nature of the offence, evidence, complicity

of the accused, submissions of the learned counsel for the

parties, larger mandate of the Article 21 of the Constitution of

India, considering the dictum of Apex Court in
