1. Heard Sri Neeraj Srivastava, learned counsel for the applicant and Sri S.K. Singh, learned A.G.A. for the State.

This is an application under Section 482 of CrPC preferred by the applicant for quashing the entire proceeding of Complaint Case No. 1015 of 2023 (Kamal Singh versus Guldeep Singh) pending in the court of learned Civil Judge (Junior Division), Fast Track Court (14th Vitt Aayog Dwara Srijit), District Rampur and summoning order dated 7.10.2023 under Section 138 Negotiable Instruments Act, 1881 .

3. Learned counsel for the applicant has submitted that a complaint was lodged by the O.P. No.2 on 27.08.2023 with reference to dishonour of a cheque of Rs.4,38,000/- on 24.05.2023 and a statutory legal notice was sent through post on 03.06.2023, which was intentionally not received by the application and thereafter complaint has been lodged. Learned counsel for the applicant submits that no legally enforceable debt or liability stood accrued in favour of the applicant and further the applicant himself has investigated certain amount in purchase of paddy and when the applicant required the complainant to spare out his share of profit, then the complain
