1. Heard Shri Shikhar Anand, learned counsel for the applicant and Shri Rao Narendra Singh, learned A.G.A for the State.

The present application under Section 482 Cr.P.C/528 B.N.S.S has been preferred with the following main prayer:- " That under the circumstances, it would be just and expedient that that this Hon'ble Court may graciously be pleased to quash the impugned order dated 02.12.2022 passed by Civil Judge, Junior Division F.T.C/J.M Faizabad in Case No. 211/2022, on application U/s 321 Cr.PC relating to Case Crime No. 115/2016 U/s 147, 323, 504, 506, 452, 427 I.P.C Police Station-Ram Janm Bhoomi, District-Faizabad as well as impugned order dated 12.12.2024 passed by Additional District and Session Judge, Court No.-12, District-Ayodhya in Criminal Revision No. 211/2022, as contained in Annexure No. 1 and 2 respectively to this petition, in the interest of justice."

The brief facts of the case are that an F.I.R dated 06.11.2016 has been lodged by the applicant against respondent nos. 2 to 6 under Sections 147, 323, 504, 452, 427, 394 I.P.C alleging therein that on the day of occurrence, at about 1:00-1:30 P.M, some persons lead by one Sudhakar Mishra had attacked the applicant and his family members, thrashed them, destroyed the temple and also threatened him for his life. They also looted the valuables from the temple. The police, after the investigation, has filed a chargesheet in all the sections mentioned in the F.I.R except Section 394 I.P.C.

An application dated 07.03.2022 was filed by the Assistant Prosecution OfÏcer under Section 321 Cr.P.C for withdrawal of the prosecution and the concerned court has allowed the same by passing the impugned order dated 02.12.2022, against which revision was preferred by the applicant, which was dismissed by impugned judgment and order dated 12.12.2024. Feeling aggrieved by the same, the present application has been preferred. The application dated 07.03.2022 is quoted hereinbelow:-
