Heard learned counsel for the applicant and learned A.G.A. for the State.

This Application under Section 483 Cr.P.C. has been filed by the applicant

with a prayer to direct the court below to hear and decide the Complaint Case

No. 311 of 2016 (Old Case No. 1683 of 2014) (Pramod Kumar Shukla vs.

Vinod Kumar) under Section 138 N.I. Act, P.S. Tharwai, District Allahabad

pending before A.C.J.M., court no. 7, Allahabad expeditiously within

stipulated time.

Learned counsel for the applicant states that complaint case was filed on

10.1.2014 and after holding inquiry u/s 200 and 202 Cr.P.C.; court below

summoned him on 13.10.2016; accused appeared and was enlarged on bail;

case is fixed for cross examination of PW-1; delay is caused due to non
