No one has put in appearance for opposite party no.2, through the

name of learned counsel for the opposite party no.2 appears in the

cause list.

This criminal appeal under Section 14-A (1) of SC/ST Act has

been filed against the summoning order dated 20.05.2023 and

cognizance order dated 20.05.2023 taken in Charge Sheet dated

23.04.2023 along with entire Criminal Proceeding of Session Trial

No. 26 of 2023 (State Versus Vivek Kumar), arising out of Case

Crime No. 0034 of 2023, under Sections 323, 504, 506 I.P.C. and

Section 3 (1) (r) (s) of SC/ST Act, Police Station Rampura, District

Jalaun, pending in the Court of learned Special Judge SC/ST Act,

Jalaun.

In the Court, learned counsel for the applicants only submitted that

some direction be issued to the court concerned regarding bail as

the applicants want to surrender before the trial court.

The application is, therefore, disposed of with the direction to the

trial court that if the applicants appear before the trial court within

20 days from today and moves an application for bail before the

trial court, the same shall be decided as soon as possible in view of

law laid down in Satender Kumar Antil Vs. Central Bureau of

Investigation and another, (2021) 10 SCC 773 .
