1. Heard Sri Rajesh Kumar Pandey, learned counsel for the

applicant and Dr. S.B.Maurya, learned AGA-I, for the State.

2. The instant application has been moved on behalf of the

applicant to release him on bail in Case Crime No. 133 of

2022, under Sections 323, 504, 308 IPC, Police Station

Gulawathi, District Bulandshahr, during pendency of the trial in

the court concerned.

3. As per the allegation, applicant along with co-accused

assaulted the son of the informant due to which he sustained

injuries.

4. Learned counsel for the applicant submitted that the applicant

is innocent and he has falsely been implicated in the present

matter and from the perusal of injury report of the injured, it

appears that he sustained only single injury on right side of his

head at the right year but injury sustained to him was found

simple and therefore, no offence under Section 308 IPC against
