1. Heard learned counsel for the parties.

2. The contention of the learned counsel for the petitioner is that

the land covered by Khata No.300 is reserved as Navin Parti but

the same has been encroached upon by some persons and therefore

the encroachments may be removed.

3. Sri Bhupendra Kumar Tripathi, learned counsel for the Gaon

Sabha has pointed out that the proceedings under Section 67 of the

U.P. Revenue Code, 2006 have already been registered in the year

2021 and, therefore, no direction can be issued in this petition.

4. Learned counsel for the petitioner states that he is pressing his

prayer no.2 in this regard which is for expeditious disposal of the

aforesaid proceedings under Section 67 of the Code, 2006.

5. Considering the facts and circumstances of the petition, the

petition is disposed of directing the court concerned to conclude

the proceedings under Section 67 of the Code, 2007 pursuant to

R.C. Form No.19 dated 10.09.2021 after giving full opportunity of

hearing to the parties concerned and following the law laid down

in the case of Rishipal Singh Vs. State of U.P. and others: 2023

(1) AWC 4 and in Leellu Vs. State of U.P. and others: 2023 (3)

ADJ 97, within a period of six months from today.
