Heard Sri R.C. Singh, the learned Senior Counsel

assisted by Sri N.D. Shukla, the learned counsel for the

petitioner and Sri Shashi Prakash Mishra, learned counsel for

respondent no.2.

Brief facts of the case are that petitioner filed a suit under

Section 229-B/209 of the U.P. Z.A. & L.R. Act with the

allegations that he was co-tenant along with the defendants of

the plot in dispute, situated in village Thanwa Mundiari and in

village Deorar. Petitioner’s father Ramdin died just before the

consolidation operation, leaving behind the plaintiff-petitioner as

his heir and legal representative. During consolidation

operation, dispute arose in respect of the plots in dispute,

situated in village Deorar and the Deputy Director of

Consolidation has finally held that plaintiff-petitioner is son of
