Heard learned counsel for the petitioner and learned Standing Counsel for the

State-respondents.

The petitioner has preferred the present petition inter-alia with the following

prayer:-

"a) issue a writ, order or direction in the nature of mandamus

commanding/directing to the respondent authorities specially Respondent No.5

i.e. Assistant Development Officer (Panchayat), Block- Mungra Badshahpur,

District Janupur to issue family/Kutumb Register to the petitioner after inclusion

her name with her deceased father namely Late Chhote Lal Yadav S/o Late Jhurai

of Village Madar Deeh, Block Mungra Badshahpur, Tehsil Machhlishahar,

District Jaunpur; expeditiously within time bound as directed by this Hon'ble

Court in the interest justice."

It is argued by learned counsel for the petitioner that various representations

were made by the petitioner as per rule 6 of U.P. Panchayat Raj (Maintenance of

Family Registers) Rules, 1971 before the authority concerned in order to record

her name along with her deceased father namely- Late Chhote Lal Yadav, in the

Kutumb Register. Copy of the said representation is annexed as Annexure No.

(4) to the writ petition. On the said representation some remarks were made by

the authority to do the needful in the matter but till date no final decision has

been taken.

Learned Standing Counsel submits that no useful purpose would be served in

keeping the writ petition pending and an appropriate direction may be issued to

respondent no.5 to consider the grievance of the petitioner.

In view of the submission advanced by the learned counsel for the petitioner and

considering the facts of the case, this Court is of the opinion that the petitioner

may be permitted to file a fresh representation alongwith the copy of the earlier

representation coupled with the remarks made therein before respondent no.5-

Assistant Development Officer, Panchayat, Block Mungra Badshahpur, District

Jaunpur, within a period of three weeks from today.

In case any such representation is filed by the petitioner, the respondent no.5

shall decide the same by reasoned and speaking order within a period of four

weeks thereafter after giving opportunity of hearing to all the concerned parties

in accordance with law.

With the aforesaid observations, the writ petition is disposed of.
