Heard Sri Ashutosh Pandey, learned counsel for petitioners and
perused the record.
Present petition under Article 227 of the Constitution of India
has been filed seeking a direction to the 10th Additional Civil
Judge(Junior Division), Basti to decide the Suit No. 771 of
1989(Raj Pati and another vs. Smt. Savitri Singh and others)
within a stipulated time period.
It is submitted by learned counsel for the petitioners that the
suit was filed by the plaintiff-respondents for cancellation of
sale deed and the learned court below vide order dated
30.3.1991 directed the parties to maintain status quo.
Defendants-petitioners had put in appearance and filed written
statement on 21.12.1989. Lastly, it is submitted that on account
of delaying tactics adopted by plaintiff-respondents, the case
could not proceed and is pending since 1989.
Without going into merit of the case, it is appropriate that the
above suit be decided expeditiously.
In view of above, 10th Additional Civil Judge(Junior Division),
Basti/Court concerned is directed to decide the Suit No. 771 of
1989(Raj Pati and another vs. Smt. Savitri Singh and others)
expeditiously, if possible within one year from the date of
production of certified copy of this order without granting
adjournment unnecessarily to either of the parties, unless there
is any legal impediment.
With aforesaid direction, the instant petition under Article 227
of the Constitution of India is finally disposed of.
