In absence of any objection, the averments contained in the

affidavit filed in support of the delay condonation application

are treated to be true, therefore, the reason shown for delay in

filing the appeal is bona fide. The delay in filing the appeal is

condoned.

The present appeal has been filed by the claimants/appellants

for enhancement of the award dated 02.02.2019 passed by

Motor Accident Claims Tribunal/District Judge, Ballia in

M.A.C. No.101 of 2016, by which the Tribunal has awarded an

amount of Rs.5,23,600/- along with 6% interest per annum to

the claimants/appellants for the death of one Krishna Singh

aged about 22 years who died in an accident which had taken

place on 01.06.2016.
