Heard learned counsel for the petitioners.

In view of the order proposed to be passed, notice need not be issued to

respondents.

The petitioners have preferred the present petition under Article 227 of the

Constitution of India with the prayer to issue a direction to the Civil Judge

(Senior Division) Kushinagar place Padrauna to decide the injunction

application 7 C filed by the plaintiff/respondents in Original Suit No.302 of

2015 (Om Prakash and another Vs. Doodh Nath @ Tiger and others).

It is argued by learned counsel for the petitioner that petitioners are the

defandant in the aforesaid suit. It is argued that without deciding the injunction

application, the court below granted interim protection on 24.07.2015. It is

argued that till then, various date were fixed in the matter but the aforesaid

injunction application has not been decided and prays that the aforesaid

injunction application be decided expeditiously.

In the facts and circumstances of the case and without entering into merits of the

case, the present petition, under Article 227 of the Constitution of India, is

disposed of directing the Court below to pass appropriate orders on the aforesaid

application expeditiously and preferably within a period of four months from the

date of production of a copy of this order. .
