Heard Sri Adarsh Singh, learned counsel for the applicant and

Sri Vimal Chandra Mishra, learned counsel for the opposite

party.

The applicant is before this Court for a direction to initiate

contempt proceeding against the opposite party for wilful

disobedience of the judgement and order dated 10.02.2021

passed in Writ A No.2317 of 2021 (Sangeeta Devi Vs. District

Basic Education Officer and 3 others.

It is argued by learned counsel for the opposite party no.2 that

the stay vacation application along-with counter affidavit has

been filed by the respondents in the writ petition. It is further

informed that rejoinder affidavit to the counter affidavit has also

been filed.

In the circumstances, unless and until submission raised in the

application seeking vacation is adequately addressed and

rejected no case for initiation of contempt proceedings is made

out.

In the circumstances, learned counsel for the applicant is

permitted to file listing application in the pending writ petition

before the writ Court. If such application is filed, the Writ Court

is requested to pass appropriate orders at least on the stay

vacation application expeditiously.

In view of the same, present petition is disposed of.
