Heard Sri Shivam Shukla learned Advocate has put in

appearance on behalf of the petitioner.

Learned Standing counsel is appearing for the respondent.

The petitioner claims to be a Non-Government Organisation,

(NGO) which was running the scheme namely Sachal Palna

Grih Yojana launched by U.P. State Social Welfare Board.

It appears that a CBI investigation has been ordered under the

directions issued by this Court in the working of certain NGOs

including the petitioner herein. The orders impugned dated

13.6.2017 and 23.6.2017 had been passed by the respondent

nos.1 and 2 namely Principal Secretary Women and Child

Welfare Department, Government of U.P. Lucknow, and

Director, Women Welfare U.P Lucknow restraining the

petitioner from running the aforesaid scheme.

Prayer in the writ petition are as under:-

"I. Issue a writ, order or direction in the nature of mandamus for the

records of the case and quash the order dated 13.06.2017 passed by the

respondent no.1 (annexure 2 to this writ petition) and the order dated

23.06.2017 passed by the respondent no.2 in so far as it related to the

petitioner (annexure 3 to the writ petition).

II. Issue a writ, order or direction in the nature of Mandamus

commanding and directing within some months CBI gives clean chit to the

clean NGOs and take immediate action against the defective/faulty

officers and release previous funds(amounts) of Sachal Palna Grih

Yojana.

On a pointed query made by the Court, learned counsel for the

petitioner admits that CBI investigation is still going on.

In view of the said admitted fact, the writ petition is found

misconceived and the same is, accordingly, dismissed.
