Petitioner is a member of Kshetra Panchayat from Gram

Panchayat Pipaliya Mehto, Block Bilaspur, District Rampur.

She has approached this Court with the grievance that funds

provided by the State Government pursuant to Government

Order dated 24.07.2020 towards Tied Grant are being

misutilized inasmuch as various permissible work specified in

clause 3.1 of the Government Order is not being undertaken and

the funds provided are being diverted to other usages. It is

stated that Block Development Officer, Bilaspur has sanctioned

various works regarding construction of road etc., which is not

the purpose specified in clause 3.1.

Sri Shubhranshu Shekhar, learned Additional Chief Standing

Counsel contends that such issues of fact can be examined by

District Magistrate, Rampur and necessary action would be

taken by him as per law.

In the facts and circumstances, it would be appropriate to

dispose of this writ petition with the direction upon District

Magistrate, Rampur to examine the issue and to ensure that

funds provided by State under a particular scheme are utilized

for such work only and is not spent on works which are not

specified in the Government Order dated 24.07.2020. An

appropriate decision in that regard would be taken within a

period of two months from the date of presentation of a

certified copy of this order.

Writ petition is, accordingly, disposed off.
