Allegation in the first information report is that the

applicants along with six named accused and 4-5 un-

named accused caused injuries to Smt. Lachhi Devi and

Munshi and Smt. Lachhi Devi died. In the first information

report there are general allegations made against all the

accused persons. Injured, Munshi, was also beaten by

accused persons along with Smt. Lachhi. He has stated in

his statement that all the accused persons kept a danda

on the neck of Smt. Lachhi and caused her death by

pressure on her neck.

Learned counsel for the applicant submitted that the

death of the deceased has not being caused as a result of

throttling rather she died on account of head injuries

suffered by her from some hard and blunt object. From
