Sri Satendra Singh, learned counsel for the petitioner is present,

Sri Chitranshu Srivastava appears on behalf of respondent nos.

4 and 5 and learned A.G.A. is present on behalf of the State.

In compliance with the rule nisi issue don 21.09.2020, the

detenue Smt. Pavitra has been produced before this Court by

lady constable, Priyanka (L/C 362) posted at P.S. Bichhawan,

District Mainpuri, who has identified the detenue before the

Court. This Court, accordingly, proceeds to ascertain the stand

of the detenue in the matter, verbatim:

A. Pavitra.

Q. Aapke pitaji ka naam?

A. Shri Sarvesh Kumar.

Q. Aapki aayu?

A. 28 years.

Q. Aap kaha se aayi hain?

A. Mainpuri se.

Q. Mainpuri me kiske paas rah rahi thi?

A. Apne pati ke sath.

Q. Aapke pati ka kya naam hai?

A. Anil.

Q. Aapko aapke Maa-Baap le gaye the?

A. Ha.

Q. Aap apne pati ke paas kaise pahunchi?

A. Mere sath maar-peet karte the.

Q. Fir kya hua?

A. Mai thane chali gayi, fir unhone mujhe mere pati ke sath bhej diya.

Q. Aap kiske saath jana chahati hain?

A. Anil ke sath.

Looking to the aforesaid stand of Smt. Pavitra, it appears that

pending this writ petition, she has been liberated from the

custody of respondent nos. 4 and 5 by the police and she is back

with the petitioner. Therefore, nothing survives to be

determined in this petition. It is, accordingly, consigned to

records.

The detenue, who has been brought by the police, is free to go

back with her husband as indicated by her.

The sum of Rs. 20,000/- deposited by the petitioner under

orders of this Court, shall be refunded to him in account

forthwith through an appropriate bank instrument payable at

Mainpuri by the Registrar General.
