Heard learned counsel for the applicant and learned A.G.A. for

the State as also perused the record.

The present 482 Cr.P.C. application has been filed to quash the

entire criminal proceedings of Complaint Case No. 2531 of

2018 (M/s Garg, agency Vs. Satendra Kumar Guputa) pending

in the court of Additional Court, Court No. 2, Under section 138

N.I. Act, Police Station Sikandra, District Agra.

Learned counsel for the applicant submits that on the basis of

the false, fabricated & concocted allegation opposite party No.

2 has filed a complaint dated 08.10.2018, on which the learned

Additional Court, Agra has summoned the applicant which is

erroneous & liable to be quashed by this Hon'ble Court. Further

submitted that in the present case learned court below in a very

hurried manner summon the applicant under section 138 N.I.

Act.

The prayer for quashing the same is refused as I do not see any

abuse of the Court's process either.
