This petition is placed before the Court in Chambers by the

Registry, as the precautions required to be taken up in view of

the COVID-19 pandemic requires various strict measures,

including following of social distancing etc. Consequently, the

appearance of parties and their counsel/s is dispensed with. I

have perused the records.

This writ petition has been filed challenging an order dated

8.1.2020, passed by Tehsildar, Manjhanpur, District Kaushambi,

against which a revision has already been preferred by

petitioners. The Board of Revenue has entertained the revision

and has issued notices to the parties concerned. It is at this stage

that the present writ petition has been filed challenging the

order passed by the Tehsildar and also for a direction upon the

revisional authority to decide petitioners' stay application in the

pending Revision No.391 of 2020.

Since the order of Tehsildar has already been challenged in

revision, there is no occasion for this Court to entertain a

challenge to the order, which is already subjudice in revision.

The revisional court has issued notices to the parties, fixing

14.4.2020 as the date in the matter. Since the revisional

authority is already seized of the matter and there is no undue

delay, no specific direction is required to be issued in favour of

the petitioners.

However, it goes without saying that the revisional authority

would make all endeavours to dispose of the pending interim

application filed in the petitioners' revision, without granting

any unnecessary adjournment to either of the parties.

Subject to the observations made above, this writ petition is

disposed off.

The concerned Authority/Official shall verify the authenticity of

computerized copy of this order from the official website of

High Court Allahabad and shall act accordingly without waiting

for submission of the certified copy of this order.

Since this order has been passed in the peculiar facts and

circumstances without hearing the counsels for the parties

concerned, liberty however stands reserved to either of the

parties to apply for recall/review of the order in case they feel

so aggrieved.
