The writ petition has been preferred against the order dated 13.5.2010 passed by
Central Administrative Tribunal, Allahabad. The Tribunal by the aforesaid order
dismissed the original application of the petitioner whereby the petitioner was
not allowed to withdraw his resignation.
It appears from the record that the petitioner submitted his resignation on
8.9.2008. The said resignation was accepted by the competent authority on
30.9.2008 and he was relieved from his duties on the same very date. Thus, the
resignation of the petitioner on being accepted, became effective with effect
from 30.9.2008. The petitioner thereafter made an application on 20.11.2008 for
the withdrawal of his resignation. When no orders on the said application was
