Heard learned counsel for both side over application moved

under Section 378(4) Cr.P.C. for grant of leave to appeal for

filing appeal against judgment of acquittal passed by Court No.

2 of Additional Sessions Judge, Pilibhit, in Sessions Trial No.

229 of 2017, under Section 395 I.P.C., Police Station Kotwali,

District Pilibhit.

Learned counsel for appellant argued that complainant and her

two witnesses were fully intact in their testimony, recorded

before trial court. On the basis of these evidence, those accused

persons were summoned and they stood on trial, but trial court

failed to appreciate the facts, placed on record, and on the basis

of surmises and conjectures, this impugned judgment of

acquittal, whereas case of prosecution was fully proved before

trial court. Hence, this appeal with above prayer for grant of

leave.
