P.K.Chauhan, learned Standing Counsel for the State-

respondent.

Petitioner is before this Court assailing the order

impugned dated 13.9.2018 passed by the second respondent.

Record in question reflects that the petitioner is one of

the complainants on whose complaint the fair price shop

agreement of the fourth respondent was cancelled by order

dated 27.9.2017 passed by the third respondent. The said

order has been assailed by the fourth respondent by

preferring an appeal Case No. 1153 of 2017 (Computerised

Case No. C201709001153), under Section 28 of the U.P.

Essential Commodities Distribution Order, 2004 before the

second respondent, which has been allowed by the impugned

order dated 13.9.2018 and the fair price shop agreement of

respondent no. 4 has been restored. The petitioner was not

even a party in the appeal before the respondent no. 2.
