Heard Sri Bharat Singh, learned counsel appearing for the

appellant on the application seeking leave to appeal against the

judgment and order dated 30.06.2018 passed by Additional Sessions

Judge, Court No. 10, Shahjahanpur by means of which

accused/respondents have been acquitted of the offence under sections

147/323 IPC read with section 149 IPC and section 302 IPC read with

section 149 IPC and 504 IPC.

By giving the benefit of doubt at this stage itself it may be

appreciated that one other co-accused Sarvendra who was assigned

specific role Shiv Kumar who has received only one injury and died.

Keeping in view the contentions as has been raised at Bar of this Court

and the ground taken in appeal the court has gone through the evidence

as recorded by the court concerned has been given cogent reasons for

arriving at this conclusion and returning the verdict of acquitt
