Heard learned counsel for the parties and perused the record.

The present criminal appeal has been filed along with an

application for seeking leave to appeal against the judgment and

order dated 28.3.2018 passed by Additional Sessions Judge,

Court no. 2, Meerut in S.T. No. 145/2015 in Case Crime No.

583 of 2014 by means of which the accused-respondents have

been acquitted of the offences under Sections 420, 468, 471,

120(B) 323, 504 and 506 IPC and Section 66(5) of IT Act, P.S.

Kankarkhera, District Meerut.

The counsel for the appellant while arguing the application

seeking leave to appeal against the judgment and order dated

28.3.2018 has placed reliance upon the testimony of the girl

under Section 164 Cr.P.C. Nevertheless the record shows that

Section 9 proceedings are pending which has been filed by the

accused-respondents in his capacity
