This revision is directed against the order dated 17.01.2018

passed by the Civil Judge (Senior Division), Gautam Budh

Nagar, whereby an application under Order 7 Rule 11 CPC filed

by the revisionist, has been rejected.

The plaintiff respondent filed the suit No.682 of 2017 seeking a

declaration that the judgement and decree dated 30.05.1987

passed by the Civil Court cancelling a sale deed executed by the

recorded tenure holder in favour of the plaintiff, be declared,

null and void. An injunction is also claimed for restraining the

defendants from interfering in the plaintiffs peaceful possession

over the land in suit and also for restraining them from creating

any third party interest in the land in suit.
