Heard learned counsel for the applicant on the application

seeking leave to appeal against the judgment and order dated

17.10.2017 vide which the accused respondents have been

acquitted of the offenses under Section 302 of I.P.C.

The contention of learned counsel for the applicant is that

the accused respondents have wrongly been acquitted of the said

offenses. Nevertheless the fact remains that the court has gone

through the entire evidence on record and thereafter recorded the

finding. The present case is based only on the circumstantial

evidence. There is no witness who can claim to be an eye witness.

There is no recovery from the accused respondents. As far as the

first informant Reena is concerned there is no eye witness and

other person. Neeranjan happens to be the real brother of Reena

and thus the court has clearly observed and concluded herein as
